According to reports, Donte’ Stallworth was legally drunk when he struck and killed a man with his automobile early Saturday morning.
Reports from local television stations and the Miami Herald both stated that Stallworth’s blood alcohol content was above the legal limit of .08, with reports being that it was .12.
Miami police would not confirm these reports, and said they expect their toxicology reports to be back on Friday. They will not confirm any results until any potential arrests are made.
At about 7 a.m. on Saturday morning, Stallworth’s Bentley struck and killed 59-year-old Mario Reyes, a construction worker on his way home from work.
If Stallworth was in fact drunk at the time of the accident, he faces possible charges for DUI manslaughter, which carries a maximum 15-year prison sentence.
Stallworth is said to be grief-stricken, and released a statement through the Cleveland Browns on Wednesday, saying:
“My family and I are grief stricken over the tragic accident which occurred Saturday on Miami Beach where Mario Reyes sadly lost his life. My thoughts and prayers are with the Reyes family during this incredibly difficult time. Unfortunately, since this accident is still under police investigation, I cannot comment further on the matter at this time.”
Stallworth just finished his first year of a seven-year, $35 million contract with the Browns, but only played in 11 games due to injuries. He had just 17 catches in those 11 games.
